Last week, our legal team attended a three-day Case Management Conference (CMC) at the High Court in London—a crucial step in preparing for the October 2025 trial.

The outcome? Significant progress was made, and the Judge confirmed that the claims remain on track, ensuring that vehicle manufacturers cannot delay proceedings.

Key Developments from the High Court Hearing

The CMC, held from 5-7 March 2025, addressed critical legal, evidential, and procedural matters that will shape the upcoming trial. Discussions focused on:

Expert vehicle testing –The scope and timetable for engineers to conduct testing on selected sample vehicles.
Manufacturer documents – Access to confidential vehicle data and its availability to third parties.
Disclosure obligations – Ensuring manufacturers produce key documents that could hold them accountable.
Expert evidence – Determining whether additional expert reports will be needed before trial.
Trial preparations – Setting clear directions for witness statements, evidence submissions, and procedural steps ahead of October.

A Victory for Claimants

The hearing was a success, with Claimant barristers pushing back against attempts by manufacturers to delay proceedings. The Judge ruled that the case is progressing as planned and that the trial in October 2025 will move forward as scheduled.

The trial will be a pivotal moment, determining whether the sample vehicles contained unlawful cheat devices—a ruling that could have major implications for all manufacturers and affected Claimants.
